The 30 Rock star was involved in a horrific car crash in early June which claimed the life of one of his friends.

He had been recovering in a rehabilitation unit in the Robert Wood Johnson University Hospital (pic below) in New Jersey since the crash on June 7 which claimed the life of fellow comedian James McNair.

The actor broke both legs, his nose and some ribs but has shown enough progress to continue his recovery process at home under an ‘aggressive outpatient programme’.

The crash was allegedly caused by a speeding Walmart truck and on Thursday, Morgan’s lawyers initiated legal proceedings against the multi-national retail corporation. The driver has been charged with death by auto and assault by auto charges.

Morgan’s lawyers have sued Walmart for negligence, claiming the retailer should have known that its driver had been awake for more than 24 hours, and that a 700-mile commute from his home in Georgia to work in Delaware was “unreasonable”.
