According to sources Tekashi 6ix9ine will likely be re-sentenced sometime next week for a video he posted online of a 13-year-old girl engaging in a sex act.
6ix9ine (real name Daniel Hernandez) wasn't present at the closed-door conference yesterday where Justice Felicia Mennin, prosecutors and his defence lawyer discussed the the case.
He’s been in federal custody ever since being indicted earlier this month on racketeering and firearms charges.
In October, Mennin sentenced the "FEFE" rapper to 1000 hours of community service and four years probation in relation to the 2015 case that saw him charged with posting child porn on the internet. Prosecutors in the case wanted him to serve one to three years behind bars.
Assistant DA Sara Weiss had argued in Manhattan Supreme Court that 6ix9ine had violated his plea deal by getting re-arrested twice and joining a gang during the probationary period.
Stating that these brushes with the law were "technical violations" of his plea deal, Mennin let him off with the minor penalty.
Now that he’s being held without bail on the new federal case, 6ix9ine can’t be on probation so he’ll get time served, the source said.
Dawn Florio, the rapper's lawyer, declined to comment.
