Garda arrests prostitute, returns to her apartment later that day to have sex with her

A male Garda was fined for a ‘breach of discipline’ following an internal Garda inquiry after admitting to having ‘consensual sex’ with an eastern European sex worker at her apartment in the Midlands, where he had arrested her earlier on the same day.

The rented apartment in the Midlands had been raided by Gardai because it was being used as a brothel; under European law, the selling of sex by more than one person on a premises constitutes that definition.

According to the Irish Independent, the Garda admitted to having ‘consensual sex’ with the woman but denied raping her, having been accused of doing so by the alleged victim and another woman, both of whom had been arrested after admitting prostitution offences.

The Garda claimed he was off-duty when he returned to the apartment and has since been fined for a breach of discipline; details of the case were published on the Garda Ombudsman website on Friday.

As well as the alleged rape victim, a second woman, a colleague of the victim, also accused the Garda of rape and said that she had witnessed it taking place.

The Garda Síochána Ombudsman Commission (GSOC) said that a file had been prepared by its investigators and submitted to the Director of Public Prosecutions, who declined to bring any criminal charge.
