1. Use of this site

2. Definitions

“You” means you, the user of the JOE.ie Site and “Your” shall be interpreted accordingly. “We/Us” means JOE.ie and “Our” shall be interpreted accordingly. “JOE.ie Site” shall have the meaning as set out above. “User Information” means the personal details which may be provided by You to Us via the JOE.ie Site. “Users” means the users of the JOE.ie Site collectively and/or individually as the context admits. “Website” means a site on the World Wide Web.

3. Acceptable Use

You agree that any use by You of the JOE.ie Site shall be in accordance with the following conditions:

1. You will not post or transmit through the JOE.ie Site any defamatory, threatening, obscene, harmful, pornographic or otherwise illegal material or material which would violate or infringe in any way upon our rights or those of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience. You must not express opinions that are vulgar, crude, sexist, racist , discriminatory, or otherwise offensive or in breach of an laws. Always treat other Users with respect.
2. You will not post or otherwise make available on the JOE.ie Site any material which You do not own without the express prior written permission of the owner of the material.
3. You will not copy, download, reproduce, republish, frame, broadcast, transmit in any manner whatsoever, or make available any material on the JOE.ie Site except as is strictly necessary for Your own personal non-commercial home use.
4. You will abide by the specific rules of any competition or promotion that You participate in on or via the JOE.ie site.
5. You will not do anything that affects the operability or security of the JOE.ie Site or causes unreasonable inconvenience or offence or disruption to our staff or users.
6. JOE.ie reserves the right to alter, edit, modify, remove or shut down all or part of the JOE.ie Website or its contents without further notice.

4. Third Party Websites

1. The Site contains links to third party Web Sites, including those provided by advertisers and commercial sponsors. These links are provided solely as a convenience to you and not as an endorsement by JOE.ie of the contents of, or goods or services provided by such third party Web Sites. JOE.ie is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of information contained on such third party Web Sites. If you decide to access linked third-party Web Sites, you do so at your own risk.
2. JOE.ie generally welcomes the hyper-linking to the JOE.ie Site from other appropriate Web Sites provided such links are to the Sites homepage (and no deeper within the Site) and provided JOE.ie gives its consent to the establishment of such links. Notwithstanding the foregoing, JOE.ie reserves the absolute right to refuse to consent to such links without giving reasons. Any links to the JOE.ie Site from another Web Site must be presented in such a manner that the viewing of the JOE.ie Site is not impaired by framing or similar techniques that may impair the visitor’s user experience.

5. Intellectual Property

1. All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the JOE.ie Site shall remain at all times vested in Us or Our licensors. You are not permitted to use this material or content unless expressly authorised in writing by Us or Our licensors. You will not, and You will not assist or facilitate any third party to, copy, reproduce, transmit, distribute, frame, make available, commercially exploit or create derivative works of such material or content.
2. If You become aware of any such distribution or commercial exploitation, You agree to notify Us immediately.
3. You acknowledge that by posting or sending material or content to the JOE.ie Site You grant to Us and Our licensors and assigns an irrevocable, perpetual, royalty free, worldwide licence to use the materials both within the JOE.ie Site and in any other manner. The licence extends to copying, distributing, broadcasting, and otherwise transmitting, and adapting and editing the materials.

6. Liability for and information provided on the JOE.ie Site

1. Material which is posted on any bulletin boards is written by Users and We are not responsible for and do not endorse such material. We reserve the right to monitor the contributions made and may respond to or comment upon communications made by You and edit, refuse to post, or remove any content from the bulletin boards in our absolute discretion. No failure to remove particular material constitutes an endorsement or acceptance of it by Us.
2. We will not be held responsible or liable for the content, accuracy, timing or reliability of any information or statements contained within the JOE.ie Site, or for statements, advice and/or opinions made or given by Users on the bulletin boards . If You have any claim arising from the actions or statements of another User, You agree to pursue such a claim only against that User and not against Us.
3. We will endeavour to provide the JOE.ie Site using all reasonable care. On occasions our site may publish articles or features, which some site visitors may find offensive. JOE.ie does not intend to offend and suggests that site visitors who find the tone or content of the site offensive, no longer visit the site. No responsibility is taken for any offense caused. To the maximum extent permissible by law, JOE.ie disclaims all warranties in relation to the content of the JOE.ie Site and makes no representation or warranty in respect of the JOE.ie Site or the material contained therein or its quality, accuracy or fitness for purpose. Further, JOE.ie makes no representations that the material contained in the JOE.ie Site, or any of the functions contained in the JOE.ie Site or its server will operate without interruption or delay or will be error free, free of viruses or bugs or is compatible with any other software or material.
4. We will be liable for any fraudulent misrepresentations We make and for any death or personal injury caused by Our negligence. We will not be responsible or liable to You for any other loss or damage that You or any third party may suffer as a result of using or in connection with Your use of the JOE.ie Site.
5. JOE.ie disclaims liability in connection with Your use or misuse of the JOE.ie Site to the maximum extent permissible by law.

7. Competitions

Unless otherwise stated the promoter of competitions on the site is JOE.ie. Entrants must be over 18 and resident in Ireland. Employees/families/agents of the promoter and its associates are not eligible. One entry per person/per household. No purchase is necessary. Details of the winner can be requested. Prize is subject to availability/may be substituted. Please allow a period of 30 days for prize to be delivered (if applicable) upon winning the competition. No cash alternative/prize is non-refundable/non-transferable. The promoter accepts no liability for lost/damaged/incomplete entries. Proof of entry is not proof of delivery. The winner may need to sign a statement of eligibility/liability/publicity release. Third party T&Cs may apply. Details of entries will be kept on a database and may be used and passed to third parties to enable the processing of Completion/prize fulfillment/ where entrant has consented to share this information with other companies for marketing. To the extent as permitted by Irish law, the promoter excludes all liability for any loss in connection with the competition.

8. Privacy

1. We shall comply with all applicable data protection legislation from time to time in place in respect of any personal information relating to You gathered by Us.
2. You may be asked to input information about yourself on different pages of the JOE.ie Site. We will not use the information You provide to Us for any purpose t other than as stated at each location where such information is requested.
3. Please email dataquery@maximummedia.ie to notify Us of any changes to the information You have previously given or if You wish to withdraw Your consent to Our using Your User Information for the stated purposes or for any form of promotional contact.

9. Indemnity

You agree to indemnify Us, and/or any of Our affiliates and including their officers, directors and employees, servants and agents immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by You, and (if applicable) your officers, directors and employees, servants and agents and against any other liabilities arising out of Your use of the JOE.ie Site.

10. Termination

We reserve the right immediately to terminate Your use of the JOE.ie Site in circumstance including (but not limited to)_ where You or (if applicable) your officers, directors and employees, servants and agents breach or procure a breach these terms and conditions or otherwise engage in conduct which We determine in Our sole discretion to be unacceptable or harmful to JOE.ie or its users.

1. By using or accessing this page you agree to all the relevant conditions in the terms of service for Facebook, to these guidelines and the terms and conditions (listed above) on the JOE.ie website.
2. User comments on the JOE.ie Facebook page do not reflect the opinions of JOE.ie, nor do we accept or confirm their accuracy.
3. All competitions running on the JOE.ie Facebook page will be subject to, but not limited to, our standard Terms and Conditions.
4. JOE will endeavour to reply to as many comments and queries as possible where appropriate.
5. We ask users to post commentary that is both relevant and respectful to this community as a whole. We moderate reactively and reserve the right to remove comments and/or block users based on the following:
6. Comments, links, images or videos that are inappropriate (i.e. obscene, profane or hateful in nature);
7. Comments that are abusive, harassing, stalking, threatening or attacking of any individual person, group or legal entity;
8. Comments that are potentially defamatory or libellous;
9. Comments which could prejudice any active legal proceedings;
10. Spam, solicitations or advertisements. This includes promotion or endorsement of any financial, commercial or non-governmental agency;

12. Uploading files that contain viruses or programs that could damage the operation of other’s computers.
13. You retain your rights to any content you submit, post or display on or through JOE’s online platforms. By submitting, posting or displaying content on or through JOE’s online platforms, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).

13. General

1. If any court or regulator decides that any provision of these terms and conditions is invalid or otherwise unenforceable, such provisions shall be severed and deleted from these terms and conditions and the remainder of these terms and conditions shall continue to have full force and effect.
2. We reserve the right to change the terms and conditions upon the posting of any altered terms and conditions upon the “JOE.ie Site”.

The above terms and conditions and the JOE.ie site are governed by Irish law.

BLUCOZADE BLITZ TERMS AND CONDITIONS

Entrants will be deemed to have accepted these terms and conditions, and agreed to be bound by them, when entering this Promotion.

Promoter:
The Promoter is Lucozade Ribena Suntory Ireland Limited whose registered office is 7th Floor Chase Building, Carmanhall Road, Sandyford, Dublin 18.

Who may enter:

 • This competition (the “Promotion”) is open to residents of the Republic of Ireland aged 18 or over.

 • Employees (or family members of employees) of any group company of the Promoter, companies associated with the Promotion and all affiliates of such companies may not enter this Promotion.

How to enter:

 • To take part in this Promotion visit the JOE.ie Instagram page on 10 October 2024 (the “Promotion Date”). You will need to watch the stories on the JOE.ie Instagram page on the Promotion Date and decipher the clues to work out the physical location at which the prizes are located (the “Prize Site”). No purchase necessary. Internet access required.

 • Entry requirements: Your entry to the Promotion is your arrival in person on the Promotion Date at the Prize Site (“Entry”).

 • Maximum of one entry per person.

 • The “entrant” is the person whose name is identified on the mode of entry.

 • The Promoter believes in responsible consumption of its products and does not endorse the purchasing of more product than can reasonably be used or consumed in order to participate in this Promotion.

Promotion Period

 • The Promotion opens on the Promotion Date. All entries must be received by 11:59 p.m. (Irish time) on the Promotion Date.

Winner selection and notification:

 • A representative of Maximum Media Network Limited (“Maximum Media Network”) will be present at the Prize Site on the Promotion Date to determine the winners. The winning entries will be those which, in the opinion and sole discretion of Maximum Media Network, are the first four complete, correct and eligible entries received.

 • The winners will be notified in person at the Prize Site on the Promotion Date. Any failure by Maximum Media Network to notify the winners within this timeframe shall not give rise to any claim by the winners against the Promoter.

 • Each winner must provide photographic identification to Maximum Media Network confirming that he/she is aged 18 or over.

 • The winners will receive their prizes in person on the Promotion Date.

Prizes:

The prizes are:
a) For first place, the choice of either one Xbox or PlayStation gaming console;
b) For second place, one gaming console, being the console that the first-place winner did not select (either an Xbox or PlayStation gaming console depending on what was previously chosen);
c) For third place, a Blucozade goodie bag containing a Blucozade Oodie, Bluetooth earphones, a notepad and a pen; and
d) For fourth place, a Blucozade goodie bag containing a Blucozade Oodie, Bluetooth earphones, a notepad and a pen.

 • Maximum of one prize per person.

 • Please note that there will be no reimbursement of costs of transportation or any other such costs incurred by entrants to get to the Prize Site.

 • The Promoter reserves the right to substitute the prizes (or any part of the prizes) for a prize or prizes of equivalent or greater monetary value if this is necessary in the reasonable opinion of the Promoter. There is no cash alternative to the prizes (or any part of thereof) and unless the Promoter agrees otherwise in writing the prizes are non-refundable and non-transferable.

 • If the winners are not able, for any reason, to accept a prize, the Promoter reserves the right to award the prize to another entrant.

 • Details of prize winners’ names and county will be available for three months after the close of this Promotion by writing to the Promoter at the address set out below and stating the name and date of the romotion or by emailing consumer.care@suntory.com. We reserve the right to refuse any or all such requests. Should a winner object to their information being made available or request that disclosure be limited in scope they should contact the Promoter by emailing consumer.care@suntory.com. We may nevertheless disclose the information to the relevant Advertising Standards Authority if required to do so.

Liability:

 • There are certain things for which the Promoter does not accept any liability to you, and these are explained in the next three paragraphs. The law does not allow the Promoter to exclude or limit its liability for some things, such as death or personal injury caused by its negligence, or loss caused by a false statement where the statement is made fraudulently. The Promoter accepts full liability for these matters and all matters for which it cannot, under Irish law, exclude or limit its liability. Otherwise, the exclusions of liability below will apply. References to the “Promoter” in these paragraphs include all of the Promoter’s
associated companies, agents or any other third party involved in the Promotion.

 • The Promoter will not be responsible for (and will have no liability in connection with) occurrences beyond the Promoter’s control, including but not limited to:

a) any postponement or cancellation of the Promotion;
b) any changes to prizes or the way in which they can be used;
c) any change to the location of the Prize Site;
d) problems with the dispatch of prizes (such as prizes failing to reach the intended
recipient);
e) any taxes, fees, charges or other costs which winner(s) may be required to pay at
any time in connection with a prize (except to the extent that the Promoter has
expressly and specifically accepted responsibility for the same); and
f) any act or default of any third party supplier.

 • The Promoter does not accept responsibility for any issues or complications arising from your participation in the Promotion. You are solely responsible for ensuring that you are physically fit and able to participate in the Promotion, including, but not limited to, your safe travel to the Prize Site. You are solely responsible for making the necessary arrangements to reach the Prize Site and taking all precautions necessary to reach the Prize Site safely and punctually. The Promoter is not responsible for any difficulties you may encounter in locating the Prize Site, arriving in time, or for any delays or disruptions caused by weather conditions, transportation or any other external factors.

The Promoter does not accept responsibility for network, computer, hardware or software failure of any kind, which may affect the sending, receipt or processing of your Entry. If this Promotion is unable to run as  • planned due to computer virus, network / technical / communications failure, tampering or any cause beyond the Promoter’s reasonable control, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion or invalidate any affected entries (subject to any written directions given under applicable law).

 • Entries must be made directly by the person entering the promotion and not through agents or third parties. If it becomes apparent that an entrant is using computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize awarded will be void. Incomplete entries will also be disqualified and will not be counted. The Promoter is not obligated to inform the entrants who have entered such entries of such disqualification.

 • Maximum Media Network’s and the Promoter’s decisions are final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these terms and conditions will be disqualified.

 • Please note that this Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering, you acknowledge that Instagram bears no responsibility for this Promotion and, to the maximum extent permitted by law, you release Instagram from any liability whatsoever in connection with this Promotion. You understand that the information you provide is provided to the Promoter (and its affiliates, associates and agents where applicable) and not to Instagram.

 • If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the promotion, choice of prize winner(s) or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.

 • The Promoter reserves the right to amend these terms and conditions at any time without notice. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

Personal Details:

 • If you have opted in, the Promoter (and their respective business partners if applicable) may also use the details you give us to contact you for marketing purposes by post, email and/or SMS.The winner(s) agree to allow the Promoter to use their name and likeness for advertising and publicity purposes without additional remuneration. The winner(s) may be asked to take part in reasonable publicity and PR activity at the Promoter’s request.

Irish Law applies:
 • This Promotion, these terms and conditions, and any dispute or claim arising out of or in connection with them (including the prize(s)), shall be governed by and construed in accordance with Irish law. You rrevocably agree that the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Promotion and/or these terms and conditions (including the prize(s)).
